Welcome to the Prime  + Terms of Service. These Terms are between you and the company that makes the Amazon Prime Video service available to you, which means depending on your location Amazon.com Services LLC, Amazon Digital UK Limited or one of their affiliates ("Amazon", "we" or "us"). Each time you visit, browse or use the Amazon Prime Video service, you accept this Agreement on behalf of yourself and all members of your household and others using the service under your account.

1. THE SERVICE

Amazon Prime Video (the "Service") is a personalized service that offers, recommends, and helps you acquire digital films, TV shows, and other video content (collectively, "Digital Content") and other services provided in this Agreement discover. There are several ways to access this Service and the Digital Content. Access through Amazon Prime and your use of other Prime benefits and Amazon services are subject to separate terms, which are made available on the apps, websites and devices used to access those services. If you are under the age of 18 or the legal age of majority in your country, you may use the Service only with the involvement of a parent or legal guardian. We personalize content and features as part of the Service. This includes providing you with recommendations about Digital Content, features and services that may be of interest to you. We are also committed to continually improving Amazon devices and services and your experience with them.

2. COMPATIBLE DEVICES

If you wish to stream or download Digital Content, you must have a personal computer, portable media player or other device that meets the system and compatibility requirements specified by us from time to time (“Compatible Device”). For more information on supported devices, see:  USA ,  United Kingdom ,  Germany ,_cc781905-5cdebb-3b-136bad5cf58d_ Germany -136bad5cf58d_ Japan ,  all other countries . Some Compatible Devices can be used only for Streaming Digital Content, some only for Downloading Digital Content, and still others for both Streaming and Downloading Digital Content. We may change the requirements applicable to Compatible Devices from time to time. In some cases, whether a Device is (or remains) a Compatible Device may depend on the software or systems provided or maintained by the device manufacturer or other third parties. As a result, Devices that are Compatible Devices at a given point in time may no longer be Compatible Devices at a future point in time. The Amazon entity providing the Amazon Prime Video Mobile App to you may not be the same as the Amazon entity providing the Service to you.

3. GEOGRAPHICAL DIFFERENCES

Due to technical and other restrictions imposed by the content providers, this service is only available in certain locations. Digital Content (including closed captioned and dubbed audio versions of Digital Content) and how we offer that content to you will vary by time and location. Amazon determines your geographic location using appropriate technologies. You may not use any technology or technical method to cover or disguise your whereabouts.

4. DIGITAL CONTENT

a. General. The Service may enable you to: (i) access Digital Content on a subscription basis for viewing for a limited period during a subscription period (e.g., through Amazon Prime or other subscription or stand-alone video subscription (“Subscription Digital Content”) , (ii) renting Digital Content for View-On-Demand for a limited period of time (“Rent Digital Content”), (iii) purchasing Digital Content for View-On-Demand for an unlimited period of time (“Purchased Digital Content”), ( iv) the purchase of Digital Content for viewing via pay-per-view for a limited period of time (“PPV Digital Content”) and/or (v) accessing Digital Content on a free, ad-supported or advertising-based basis for a limited period of time (“Free Digital Content”).Digital Content is classified as Subscribed Digital Content, Borrowed Digital Content, Purchased Digital Content, Digital PPV Content, Free Digital Content, or any combination of such Content, and in each case is subject to the limited license grants described below.

b. Rules of Use. Your use of Digital Content is governed by the   Amazon Prime Video Acceptable Use Policy   ("Usage Rules"). The Usage Rules contain important information, including the period during which you are authorized to view different types of Digital Content (“Licensing Period”) and limitations on the number and type of Compatible Devices on which the Digital Content may be downloaded, streamed and viewed allowed to.

c. Subscriptions/Memberships. Subscription (sometimes referred to as Memberships) offerings and prices, the Subscription Services, the amount of Subscription Digital Content available, and certain titles available through the Subscription Services may vary over time and by location without change prior notice (unless prior notice is required by law). Unless otherwise stated, price changes are always effective from the beginning of the next subscription period. If you do not agree to any change in subscription, you may cancel your subscription in accordance with Section 4(d) below. Subscription or membership prices may include VAT and/or other taxes. Where applicable, these taxes will be collected by the party with whom you conduct transactions required for the Service; this can be Amazon or a third party. We cannot guarantee the availability of any specific Subscription Digital Content or the minimum quantity of Subscription Digital Content available under a Subscription. Additional terms that may apply to Subscriptions (e.g., the applicable cancellation and refund policies) are identified on the information pages for that Subscription on the primary Services website for your location. You can find them  here   (your "video marketplace").

Some of the subscription services we offer are provided by third parties. Third parties that offer subscription services (e.g., through Prime Video Channels) may change or discontinue the service they offer or its content or functionality. Amazon is not responsible for the content of any third-party subscription service or the functionality of such service.

i.e. Cancellation of Subscriptions/Memberships. If you purchased your video-only subscription or membership directly through us, you may cancel it at any time by going to "Your Account" and changing your membership settings accordingly, by contacting Amazon Customer Service, or by You complete a cancellation form that we will make available to you on your video marketplace (see  here ). If you process the applicable Amazon subscription or membership service through a third party, you may cancel through your account with that third party. If you cancel the Service within three business days of signing up or converting from a free trial to a paid membership (for UK and European Union customers: within 14 days of receiving confirmation of your subscription or membership), we will refund you the entire membership fee; however, we reserve the right to charge you for (or deduct from the refund) the value of the Service used through your account during that period. You also expressly accept that the Service will begin within your notice period. If you cancel at any other time, we will refund you the full membership fee only if no Digital Content available under your video-only membership has been accessed through your account since the last payment of the membership fee. If you access the Service as part of a Prime membership, you are subject to the cancellation and refund terms in your video marketplace's Prime Terms of Service (see_cc781905-5cde-3194-bb3b- 136bad5cf58d_here ). If you access the Service through an Amazon subscription or membership that you process through a third party, you may have different cancellation and refund policies set by that third party. You may need to contact that third party to cancel your subscription or receive a refund in accordance with their applicable policies.

e. buying and lending transactions; cancellations. Except as provided in this paragraph, all Purchased Digital Content, Borrowed Digital Content and PPV Digital Content transactions are final. A return of this digital content is excluded. You may cancel an order for Purchased Digital Content or Rental Digital Content within 48 hours of purchase or rental (for UK and European Union customers: within 14 days of the date of purchase or rental) by clicking Click "Cancel Your Order" under your Digital Orders or - for purchases billed through a third party - on the video's details page on your video marketplace (see  here ), or by using the Amazon Contact customer service. However, you cannot cancel an order for Purchased Digital Content or Rented Digital Content once you have already started downloading or viewing such Digital Content. You may cancel pre-orders of Purchased Digital Content or Rented Digital Content at any time prior to the release date of such Content. You may cancel orders for PPV Digital Content at any time prior to the scheduled launch of the Program. The release date of pre-ordered Digital Content is subject to change. If you purchased Digital Content as part of an Amazon subscription or membership purchased through a third party, the applicable refund terms will be determined by that third party.

f. Payment Methods. If you sign up for your video-only subscription or membership with us and you are also billed through us, the billing terms described below will apply to your subscription or membership.

• If it is not possible for us to carry out the payment method you have specified, we reserve the right to use one of the payment methods that we have saved from you.

• If you purchase a Subscription or begin a Free Subscription Evaluation, your Subscription will automatically continue and you authorize us (without further notice, unless required by law) to collect the then-current Subscription Fee, including taxes, using any of the Payment Methods to use what we have stored about you.

• IF YOU DO NOT NOTIFY US PRIOR TO BILLING THAT YOU WISH TO CANCEL YOUR SUBSCRIPTION OR AUTOMATICALLY RENEWAL, YOU AGREE TO THE AUTOMATICALLY RENEWAL OF YOUR SUBSCRIPTION AND YOU AUTHORIZE US (WITHOUT FURTHER NOTICE TO YOU EXCEPT BY LAW). REQUIRED) TO COLLECT THE APPLICABLE SUBSCRIPTION FEE, INCLUDING TAXES, USING ONE OF THE PAYMENT METHODS WE HAVE SAVED FROM YOU.

• If the payment methods you have saved are unable to pay your subscription fees, your subscription will be canceled unless you provide us with a new payment method. If you provide us with a new form of payment and any charges are successfully processed before your subscription is canceled, your new subscription period will begin on the original invoice date and not the date payment was made. You can change or update your payment method(s) using the settings under "Your Account".

If you signed up for your video-only subscription or membership with a third party and we do not bill you for that third party, the billing terms and conditions set by the relevant third party will apply to your subscription or membership.

G. Trial Subscriptions We may, from time to time, offer qualifying customers various trial subscriptions or other trial memberships, subject to this Agreement, except as otherwise provided in the promotional offers. We reserve the right, in our sole discretion, to determine your eligibility for these offers. Trial Members may elect at any time (through "Your Account") not to enter into a paid membership at the end of the Evaluation Period.

H. Limited License for Digital Content. Subject to payment of rental, purchase or access fees for Digital Content, and subject to your acceptance of all the terms of this Agreement, Amazon grants you a non-exclusive, non-transferable, non-sublicensable, limited license to use the Digital Content in accordance with the Usage Rules for the agreed period of use for personal, non-commercial, private use. We may automatically remove Digital Content from your Compatible Device after this Use Period has expired.

i. Availability of Purchased Digital Content. Purchased Digital Content will generally continue to be available for you to download or stream, but may no longer be available due to possible content provider licensing restrictions or other reasons. Amazon accepts no liability in the event that purchased Digital Content becomes unavailable for further downloading or streaming.

j. playback quality; streaming. The playback resolution and quality of the Digital Content you receive depends on a number of factors, including the type of Compatible Device on which you access the Digital Content and your data transfer rate, which may increase or decrease during playback . If we determine that the Digital Content you are streaming may be interrupted or not playing properly due to bandwidth limitations or other factors, we may reduce the resolution and file size of the streamed Digital Content to ensure an uninterrupted viewing experience. While we strive to provide you with a quality viewing experience, we do not guarantee the resolution or quality of the Digital Content you receive when streaming, even if you pay a premium to access high-definition, ultra-high-definition or have paid for high dynamic range.

k. General Restrictions. You may not (i) transmit, copy or display any Digital Content beyond what is permitted under this Agreement; (ii) sell, lend, lease, distribute or transfer rights in Digital Content; (iii) remove any proprietary notices or identifiers from the Digital Content; (iv) attempt to disable, circumvent, alter, disable or otherwise circumvent digital rights protection systems or other protection systems used as part of the Service; or (v) the Service or the Digital Use content for commercial or illegal purposes.

l. Measurement of viewership. For US customers only, certain third parties, e.g. B. Advertisers and content rights holders are interested in understanding how their content resonates on Prime Video Channels. When viewing certain channels, sports and live content, Amazon may share information about your viewing habits with third parties for audience measurement and market research purposes. 5. SOFTWARE

a. Use of the Software. We may make software available to you for your use in connection with the Service ("Software"). Your use of this Software is governed by the   General Terms of Use   of your video marketplace ( see_cc781905-5cde-3194-bb3b- 136bad5cf58d_here . b. Information Provided to Amazon and Video Content Providers. The Service and Software may provide Amazon with information regarding your use and performance of the Service and Software, and information about the devices on which you download and use the Service and Software. For example, the Software may provide Amazon with information related to the Digital Content you have downloaded and streamed and your use of that Digital Content (e.g., if and when you viewed the Digital Content; this helps us, among other things, estimate the usage period for determine the Borrowed Digital Content). All information we receive is subject to the Amazon data protection declaration of your video marketplace (see  here ). We may video content providers, e.g. B. Provide certain information about the status of your subscription and your use of Digital Content, including your viewing history, to third parties who offer subscription services through Prime Video Channels. We provide this information in a manner that does not identify you personally (except in the event that you authorize the sharing of personal information with a particular video content provider).

6. OTHER TERMS

a. Termination. We may terminate your access to the Service, including any subscriptions available as part of the Service, at any time and without notice (except as required by law) in our discretion. If we do so, we will refund your subscription fee pro rata (if a fee was charged). However, if you breach any of the terms of this Agreement, your rights under this Agreement will terminate automatically and without notice. Amazon may, in its sole discretion, terminate your access to the Service and Digital Content immediately without refund of any fees. In this case, you are obliged to delete all copies of the Digital Content that you have downloaded.

b. Offensive Content. By using this service, you may encounter content that may be considered offensive, indecent, or objectionable. It can, but does not have to be pointed out that this content contains offensive formulations or other characteristics. Notwithstanding, you agree to use the Service at your own risk. Amazon shall have no liability to you for any Content. Content types, genres, categories, and descriptions are provided as a courtesy to you, and Amazon is not responsible for their accuracy.

c. Messages. You may receive advertising or other communications from us electronically, including emails, push notifications, or messages to your Amazon Message Center. You hereby consent to receiving such communications. (However, if you are a customer in the United Kingdom, European Union, Turkey or Brazil, choose separately whether you wish to receive these communications.) These communications comply with the requirements of your video marketplace's Amazon privacy policy (see_cc781905- 5cde-3194-bb3b-136bad5cf58d_ here ). If you no longer wish to receive marketing communications from Amazon Prime Video, update your marketing communications preferences in your account.

i.e. Updates and Changes to the Service. Amazon will release updates to the Service, Digital Content and Software when required by law. Amazon may change the Service (including any Subscription), the Digital Content and/or the Software over time: (i) to improve existing or add new functionality and/or features; (ii) to make reasonable technical changes; (iii) to ensure the continued functionality of the Service; or (iv) for legal or security reasons, as deemed appropriate by Amazon. You agree that updates and changes may be made or applied automatically without any action on your part. If an update or change is not made automatically, it will not take effect until you install it. Amazon reserves the right to suspend or discontinue the Service, or any part of the Service, at any time without notice (except as required by law), and Amazon will have no liability to you if it exercises any of these rights, even if your ability to use digital content will be affected by this change.

e. changes. Amazon reserves the right to terminate this Agreement at any time for legal or regulatory reasons, for security reasons, to enhance existing or add additional features to the Service, to address advances in technology, to make appropriate technical adjustments to the Service, and to ensure the continued functionality of the Service change by posting the changed terms in connection with the Service or on your Video Marketplace ( here   noted). You have the option not to accept these changes by canceling your membership at any time. To the extent permitted by law, your continued use of the Service or Software following any changes made will constitute acceptance of those changes. However, any increase in subscription fee will not apply until your subscription is renewed.

f. Reservation of rights; waiver. The Service, the Software and the Digital Content are intellectual property that is protected by law. Owners of copyrights in Digital Content are third party beneficiaries for the purposes of this Agreement. Our failure to insist on or enforce your strict compliance with this Agreement will not constitute a waiver of our rights.

G. Disputes/Terms of Service. Any dispute or claim arising out of or relating to this Agreement or the Service is governed by applicable law, the disclaimer of warranties and limitations of liability, binding arbitration and class action waiver (if applicable), and any other terms of the Amazon Terms of Service Your video marketplace (see  here ). You agree to these Terms on behalf of yourself and all members of your household and others using the Service under your account by using the Service. UNDER THE LAWS OF YOUR JURISDICTION, YOU MAY ALSO BE ENABLED TO CERTAIN CONSUMER RIGHTS.

H. Limitation of Liability. Without limiting the disclaimer of liability as well as the limitation of liability set forth in the Amazon Terms of Use for your video marketplace (see here ), the following applies: (i) we or our software licensors shall have no liability to you arising out of your use of the software or any damages resulting from or related to the inability to use the Software in excess of a maximum of US$50 ($50.00); and (ii) our entire liability or that of the provider of the Digital Content to you for any damages or harm caused by your use of the Service, the Digital Content or the information, materials or products contained in the Service or otherwise made available to you in no event exceeds the amount you have paid us to purchase, rent or display the Digital Content to which your claim relates in the last 12 months. The limitations in this section apply even if the remedies fail of their essential purpose.

CERTAIN JURISDICTIONS, INCLUDING THAT OF THE EUROPEAN UNION, DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES OR THE LIMITATION OR EXCLUSION OF LIABILITY FOR CERTAIN TYPES OF DAMAGES. IF THESE LAWS APPLY TO YOU, SOME OR ALL OF THE ABOVE LIABILITY OR OTHER EXCLUSIONS OR LIMITATIONS MAY NOT APPLY TO YOU, AND YOU MAY HAVE ADDITIONAL RIGHTS.

j. Severability Clause. If any term or condition of this Agreement is deemed invalid, void, or for any reason unenforceable, that portion will be deemed severed and will not affect the validity and enforceability of any remaining term or condition.

k. Your Legal Rights. We are required by law to provide the Service and the Digital Content in accordance with this Agreement. If there is a problem with the Service or Digital Content, the laws of your country may give you additional rights and remedies. Such laws apply in addition to your rights under this Agreement.
